VideoAmp Dodges Nielsen’s TV Viewership-Measuring Patent Suit

VideoAmp Inc. once again defeated patent infringement allegations by competitor Nielsen Co. after a Delaware federal judge determined the claimed methods for data measurement are abstract, and thus invalid.

Judge Richard G. Andrews invalidated several claims of Nielsen’s US Patent No. 12,063,402, in his order filed Wednesday in the US District Court for the District of Delaware. Andrews adopted a magistrate judge’s report and recommendation in granting VideoAmp’s motion to dismiss Nielsen’s suit.

Nielsen sued VideoAmp in April 2025, alleging the competitor’s product to measure out-of-home television viewership infringed the ‘402 patent.
