The New Jersey Office of Attorney General can refuse to represent or pay for legal representation of prosecutors who are brought up on ethics charges, a state appeals court ruled Monday.
New Jersey’s Tort Claims Act requires the top cop to defend current or former state employees in “any action” brought against that worker for steps they took in the scope of their employment. However, the New Jersey Superior Court Appellate Division ruled an ethics case brought by the state Office of Attorney Ethics against Assistant Essex County Prosecutor Walter J.
