CFPB Gets Mixed Ruling in Bid to Nix Support for Mortgage Suit

A federal judge partially rejected a bid from the Consumer Financial Protection Bureau to retract a Biden-era brief arguing a mortgage servicer can be held liable for improper fees even if the servicer repays them.

The CFPB can withdraw its position as amicus supporting class action plaintiffs suing Nationstar Mortgage LLC over $25 “payoff fees,” Judge Barbara J. Rothstein of the US District Court for the Western District of Washington said in a Tuesday order. But the agency’s August brief will remain on the docket and could be used to help determine the outcome of the case, Rothstein said. ...
