President Donald Trump failed to convince the Second Circuit to give him a second shot at overturning an $83.3 million penalty in the E. Jean Carroll defamation lawsuit, but a Trump appointee, US Circuit Judge Steven Menashi, said the majority of the court made the wrong decision.

The Manhattan-based court on Wednesday rejected Trump’s request to argue before all 13 active judges for nixing the award to Carroll, a former Elle magazine advice columnist, who maintains the president sexually assaulted her and later defamed her by calling her a liar when she went public with the claim in 2019.
