KeVita Inc. beat, at least for now, a lawsuit alleging it duped buyers into thinking its prebiotic sparkling lemonade drink was “gut healthy,” as the plaintiff relied on a study about prebiotic benefits that didn’t support her allegations, a federal judge said.
Judge Jon S. Tigar of the US District Court for the Northern District of California dismissed the proposed class action complaint Aug. 8. He said one of the studies the consumer relied on doesn’t support her claims about how much gum arabica an individual must consume to achieve prebiotic benefits.
