Missouri Scores Partial Win Over Novartis Drug Discount Limits

Missouri notched a partial victory in a case on whether Novartis AG can limit the number of pharmacies it discounts drugs to under the federal 340B Drug Pricing Program.

Some of Novartis’s claims that Missouri’s law (S.B. 751) that requires manufacturers in the 340B program to deliver discounted drugs to an unlimited number of pharmacies have “failed to show a right to relief above a speculative level,” Judge Douglas Harpool of the US District Court for the Western District of Missouri wrote in an order Thursday.
