A New York-based maintenance service provider can continue litigating some trademark infringement and unfair competition claims against a competitor, a federal court said.
Folkes Home Services Heating, Cooling, Plumbing and Electrical LLC can pursue its claims under the Lanham Act but not all of its claims under New York law, the US District Court for the Southern District of New York decided Thursday.
Folkes Home Services sued Folkes Brothers Home Services LLC for infringing marks it has claimed since 2024.
