Celebrity-biography website Famous Birthdays LLC advanced a state-law data-scraping claim against an influencer-marketing website, part of a copyright suit in federal court.
Judge Consuelo B. Marshall denied Passes Inc.'s motion to dismiss the claim brought under the California’s Comprehensive Computer Data Access and Fraud Act in Famous Birthday’s amended complaint. In the order filed Wednesday in the US District Court for the Central District of California, Marshall said Famous Birthdays sufficiently pleaded a violation of the statute by alleging Passes engaged in conduct “without permission” by bypassing technical measures.
