Montana’s law requiring parents to consent to an abortion for a minor is unconstitutional, the state Supreme Court said Wednesday in a decision ending a more than decadelong legal battle.

The Montana Supreme Court ruled unanimously that the Parental Consent for Abortion Act, which has been enjoined from enforcement since 2013, violates a minor’s right to privacy. Justice Laurie McKinnon also wrote in the opinion for the court that the law infringes on “the fundamental right of a minor to control her body and destiny,” and is not narrowly tailored to advance the state’s goal of protecting minors from sexual ...
