The FBI may have pushed the limits of decency by operating a child pornography website for two weeks during an investigation, but its conduct didn’t warrant dismissing the indictment of a user caught in the operation, the First Circuit held.
The court rejected Vincent Anzalone’s due process challenge to his indictment. The FBI’s conduct wasn’t outrageous enough, the opinion by Judge Juan R. Torruella said.
While investigating the child pornography website, Playpen, the FBI was able to assume control of the site and maintained it live for two weeks. During that time, Anzalone logged into the site for 12 hours. ...
