A US Postal Service employee was wrongly denied a trial over whether she should have been allowed to work from the office only during afternoons as an accommodation for her nerve condition, a divided Fifth Circuit ruled.
The ruling Wednesday examined the recurring question of whether regular on-site attendance is an essential function of a job under the Americans with Disabilities Act. It generally is, but whether that’s so in a particular case depends on the facts at hand, the court said.
