Subaru Pares Down Class Claims Over Shaky Side-View Mirrors

Subaru of America Inc. won’t face several claims from proposed classes involving allegations that the carmaker sold SUVs with defective side-view mirrors that “shake and vibrate.”

Judge Karen M. Williams of the US District Court for the District of New Jersey dropped the plaintiffs’ claims that Subaru unjustly enriched itself and that the company committed fraudulent concealment in certain states, granting in part its motion to dismiss.

But she ruled on Dec. 31 that the carmaker still must face a range of other existing claims, including breach of warranty and deceptive practices allegations.
