United Airlines Sheds Class Action Over Covid Policies, for Now

A proposed class action against United Airlines Inc. by employees challenging its Covid-19 vaccination policies will be dismissed unless the employees file an amended complaint “stating at least one viable claim,” a federal trial court ruled.

The plaintiffs’ claim that requiring them to receive the vaccine and wear face masks violates the Food, Drug and Cosmetic Act fails because there is no private right of action under the FDCA, Judge Matthew F. Kennelly of the US District Court for the Northern District of Illinois said.
