Environmental advocates won a second chance to bring Clean Water Act claims against the Falun Gong world headquarters in Deerpark, NY after a federal appeals panel ruled Tuesday the plaintiffs provided the religious group sufficient notice of their lawsuit.
The US Court of Appeals for the Second Circuit reversed a lower court’s dismissal of the case, finding the pre-suit notice provided by the Mid-New York Environmental and Sustainability Promotion Committee and several individual plaintiffs met the law’s standards for identifying alleged activities, pollutants discharged, and location of the pollution.
