FTC Challenger Loses Bid to Halt Noncompete Case at 11th Cir.

The US Court of Appeals for the Eleventh Circuit rejected a push to pause a case over the Federal Trade Commission’s noncompete ban until separate proceedings over the rule at the Fifth Circuit conclude.

Eleventh Circuit Judge Jill Pryor said in a two-page Nov. 15 order that the court would continue to hear the matter while the Fifth Circuit weighs its own case. The order did not include an explanation.

The FTC is appealing two separate decisions that found the agency lacked authority to impose a regulation largely banning worker noncompete contracts.
