AECOM Defeats Whistleblower’s Bid to Reopen Afghanistan Suit

An AECOM whistleblower lost his appellate bid to reopen a False Claims Act suit alleging the infrastructure firm improperly billed for labor under a US Army support contract performed in Afghanistan.

A New York federal judge correctly determined that whistleblower Hassan Foreman didn’t show that the company’s allegedly flawed performance was material to government payment decisions, the US Court of Appeals for the Second Circuit said Thursday, affirming that ruling.

The government knew about alleged contractual violations but continued to make payments, and extended AECOM’s contract several times, the Second Circuit said in a nonprecedential summary order.
