A whistleblower can continue to allege that Chicago-based Roseland Community Hospital Association and other health-care providers violated the False Claims Act by billing the government for unnecessary Covid-19 tests.
Elio Montenegro, a former senior director for the hospital, adequately alleged that Roseland knowingly submitted claims for reimbursement to Medicare representing that blood tests were medically necessary when they weren’t, Judge Jeremy C. Daniel of the US District Court for the Northern District of Illinois said in a Monday opinion.
