NLRB Urges Ninth Circuit to Decide Long-Delayed Cemex Case

The National Labor Relations Board asked a federal appeals court to resume consideration of its landmark precedent to discourage labor law violations prior to union elections, after being on hold for more than a year.

Continued delay of the board’s 2023 ruling in Cemex Construction Materials Pacific LLC—which ordered the cement company to bargain with a union—is needless and unjust, the NLRB told the US Court of Appeals for the Ninth Circuit Wednesday.
