Pregnancy-Related Death Lawsuit Against US Barred as Untimely

A Massachusetts man failed to revive a lawsuit against the US that he filed nearly three years after his partner died of pregnancy complications.

Brad O’Brien didn’t bring his claim within two years of the date he reasonably should have known or suspected a doctor’s negligence caused her death, as required by the Federal Tort Claims Act, the US Court of Appeals for the First Circuit said Thursday.

O’Brien waited more than a year after the death to consult an attorney, then another 11 months to file suit, the court said.
