Texas Hemp Industry Sues Over State THC Measurement Rules

Texas health regulators’ new calculation for the amount of THC in hemp-derived products violates the state constitution and would hamstring the industry, a lawsuit alleges.

Department of State Health Services regulations went too far beyond legislative authority, business associations and THC products retailers claimed in their lawsuit filed Tuesday in Travis County District Court.

The rules adopted last month reinterpret the legislature’s .3% THC cap to factor in naturally occurring cannabinoid acids the industry says must be excluded when measuring delta-9, the compound associated with a cannabis high.
