Transgender Texas Capitol Bathroom Case Can Proceed Criminally

A Texas GOP activist who posted a photograph of a transgender woman washing her hands in a women’s restroom at the Texas Capitol isn’t entitled to civil protection from criminal prosecution, a divided appeals court ruled.

Over a dissent, Judges Priscilla Richman and Irma Carrillo Ramirez of the US Court of Appeals for the Fifth Circuit left open the door for criminal charges by affirming an injunction denial from a lower court.
