Appeals Court Blocks Attempt to Freeze EPA Good Neighbor Rule

The Environmental Protection Agency won’t have to halt broad implementation of its traveling ozone rule during litigation, according to an order issued Monday by a D.C. Circuit panel.

Judges at the US Court of Appeals for the District of Columbia Circuit didn’t find a reason for the freeze, since petitioners “have not satisfied the stringent requirements for a stay pending court review.”

The state of Utah brought the petition to the D.C. Circuit in June, aiming for a court examination of stringent ozone pollution rules that govern pollution that wanders into other states.
