Amazon’s Tax Win in India Boosts Cloud Services Firms’ Prospects

US-based companies and others selling cloud computing services in India stand to save millions of dollars in taxes if a top court ruling in favor of Amazon Web Services Inc. is allowed to stand.

AWS-provided services don’t involve royalties or fees that qualify for taxation under the India-US double taxation avoidance treaty, the Delhi High Court said in rejecting India’s effort to collect tax on $147 million of income.

Dozens of foreign companies that offer such services in India have received similar tax demands, tax practitioners said.
