Developers Owe City Overpaid Tax Subsidies, Minnesota Judge Says

Developer CSL Rose Arbor LLC and another entity must repay tax increment financing received from the City of Maple Grove, Minn., after successfully reducing the property assessments for two senior housing facilities on which those payments were based, a Minnesota Tax Court ruled.

“Although property owners may always challenge their assessments, we find it unreasonable that Rose Arbor would both retain the benefit of artificially high TIF payments and then seek to lessen its own property tax burden without recognizing the TIF payments need recalculating,” Judge Jane N.
