Germany Tax Agency Clarifies Cross-Border VAT Exemption Under European Small Business Regulation

The German Federal Central Tax Office Oct. 7 posted online guidance on the cross-border VAT exemption for small businesses under EU Directive 2020/285, the European Small Business Regulation (EU-KU Regulation), effective Jan. 1, 2025. The guidance includes: 1) the cross-border VAT exemption for small businesses engaging in intra-EU supplies of goods or services; 2) the 100,000 euros (US$109,160) annual turnover limit for the previous and current calendar years, to qualify for the exemption; 3) the April 30, July 31, Oct. 31, and Jan. 31 electronic filing deadlines for previous quarter turnover reports; and 4) registration, recordkeeping, and reporting requirements.
