IRS Faces $86 Million More in Conservation Easement Donor Claims

A pair of southeastern land partnerships sued the IRS for denying more than $86.3 million in their claimed charitable tax deductions for conservation easement donations.

North Carolina-based Hillsman Crossing LLC and Georgia-based Coosa Springs LLC each accused the federal government of acting arbitrarily and capriciously when issuing their respective partnership adjustments for the 2020 tax year, in violation of the Administrative Procedure Act.

The businesses each donated easements encumbering tracts of land they owed, then claimed deductions for the purported value of those rights.
