Italy Tax Agency Clarifies VAT Obligations of Company Incorporated Outside VAT Group

The Italian Revenue Agency Feb. 23 issued Letter No. 52/2024, clarifying the VAT obligations of a company incorporated outside a VAT group. The taxpayer, part of a VAT group, was the surviving company following a merger with other entities from outside the VAT group. The taxpayer suspended VAT during the group’s existence and sought clarification as to whether the annual VAT return for 2023 must be presented by the surviving company or by the representative of the VAT group.
