Pennsylvania Commonwealth Court Rules on Hotel Rental Tax on Complimentary Rooms

The Pennsylvania Commonwealth Court affirmed the lower court’s ruling that Taxpayer does not owe hotel room rental tax on complimentary rooms provided to patrons. The dispute arose when Luzerne County issued Taxpayer an assessment for unpaid taxes on complimentary rooms from Jan. 2016 through Aug. 2018. The court found that the language of the Third Class County Convention Center Authority Act and related ordinances clearly requires the payment of consideration in exchange for hotel rooms to trigger the tax, and complimentary rooms do not involve such payment.
