Poland is challenging the legal basis for the EU’s carbon border tax at the Court of Justice of the EU.
The Polish Ministry of Climate and Environment said Wednesday that the carbon border adjustment mechanism, or CBAM, was implemented using a qualified majority instead of unanimity in the European Council, and called the move a “defective legal basis” for the new measure.
The Council approved the CBAM in April with plans for it to go into effect from Oct. 1.
