South Africa Tax Agency Posts Court Decision on Diesel Fuel Tax Refund for Mining Company

The South African Revenue Service Oct. 8 posted online Supreme Court of Appeal Decision No. 462/2020, explaining the application of diesel fuel tax refunds for a mining company. A coal mining company operated its business at its various mines in South Africa, for which the company claimed refunds against the diesel fuel tax. The commissioner disallowed some of the company’s refund claims. The court held that the company is eligible for refunds only for those claims which relate to the company’s primary production activities in mining.
