Tennessee Imposes Henry County Severance Tax, Contingent on Approval

The Tennessee Governor signed a law that includes: 1) imposing a severance tax in Henry Coounty on clay, titanium, and any other substance commonly recognized as a mineral not already taxed by the state; 2) setting the tax rate at the maximum rate per ton authorized by Tennessee Code Annotated section 67-7-203, or any higher rate if subsequently amended, and not lower than any maximum rate if subsequently amended to lower the rate or repeal the tax; and 3) providing the tax is effective only if approved by two-thirds vote of Henry County’s legislative body.
