US Can Enforce Section 122 Tariffs Until Appeals Court Rules (1)

The Trump administration scored a key procedural win over a group of states and small businesses challenging the 10% global tariffs instituted in February, after a federal appeals court ruled the government can enforce the levies while the fight plays out.

The US “made a sufficient showing” that it’s likely to win the dispute over President Donald Trump’s use of Section 122 of the Trade Act of 1974 to issue tariffs, a federal appeals court in Washington held Thursday.

Allowing the tariffs to continue for now is “warranted under the circumstances,” the court said.
