Advertising Consultants Win Partial Refund of New York Sales Tax

Certain services provided by two media research firms are excluded from New York sales and use tax because they furnish personal information that isn’t included in reports to other clients, a state tax judge ruled in an opinion posted Thursday.

Other services that incorporate data from clients into widely distributed products are taxable information services, New York Division of Tax Appeals Administrative Law Judge Alexander Chu-Fong wrote in the mixed ruling. As a result, the companies are entitled to a partial refund of three tax bills totaling $17.9 million, plus interest.
