Atlanta Airport Restaurant Owner Avoids Property Tax on Appeal

The owner of several restaurants at Hartsfield-Jackson Atlanta International Airport convinced the Georgia Court of Appeals Tuesday that it’s entitled to a refund of all property taxes that Clayton County and the City of College Park, Ga., imposed on its leases.

Leased retail space at the airport to operate food concessions isn’t subject to property taxes because the leases represent the right to use real estate, not ownership, Judge Amanda H. Mercier wrote for the court.
