Changes to California Digital Ad Tax Bill Tighten Legal Defenses

Amendments to a proposed digital advertising tax in California would set the the levy’s effective date in 2026, limit the tax to ad revenue above $2.5 billion, and attempt to put the tax on stronger legal ground.

The proposal (S.B. 1327) from Sen. Steve Glazer (D) passed the Senate in June and has been referred to the Assembly Revenue and Taxation Committee, which hasn’t scheduled it for a hearing yet. It must pass before lawmakers end their 2024 session on Aug. 31 to reach Gov. Gavin Newsom (D). He hasn’t taken a position on the bill.
