Delta Air Lines Sues Florida for Tax Refund on In-flight Meals

The Florida Department of Revenue mischaracterized food Delta Air Lines Inc. purchased in the state to serve on its flights for tax purposes, the company alleges in lawsuit filed in state court Wednesday.

Delta requested $1.8 million in use taxes it alleged it overpaid between 2012 to 2020. Florida conceded that snacks and drinks the airline purchased were tax exempt and granted a partial exemption, but declined to refund taxes on prepared meals, according to the carrier’s complaint filed in the Florida Circuit Court for Leon County.
