A Delaware-based multilevel marketing company that sells weight-loss supplements is due a California refund of about $150,000 because the state didn’t prove it misapplied sales tax on out-of-state transactions.
The California Superior Court of Sacramento County acknowledged that Body Wise International LLC’s invoices could confuse customers about whether the itemized “tax amount” refers to California sales tax or tax for some other jurisdiction. “But Body Wise provided testimony and documents refuting the argument that it had represented that the charges in question were taxes due to California,” Judge Peter K. Southworth said in a tentative ruling Thursday.
