Fiserv Unit’s Sales Tax Case Should Be Remanded, Ohio Argues

The Ohio Board of Tax Appeals was right to remand a sales tax case involving a Fiserv Inc. subsidiary to reconsider the true object of each separately billed service it provides, the tax commissioner told the state’s high court.

CheckFree Services Corp. wants the Ohio Supreme Court to rule on its claim for a sales tax refund nearing $2 million rather than follow its intervening ruling that rejected an all-or-nothing approach to determining the object of transactions that bundle automated and professional services, Tax Commissioner Patricia Harris argued in her response brief filed Wednesday.
