Counties aren’t immune from taxation on property they own in other counties, a Florida appeals court ruled Sept. 25.
The case involved 12,400 acres owned by Florida’s Pinellas County but located in Pasco County. Pinellas County argued it had immunity from taxation, while Pasco County argued it had the right to tax the property.
“This case presents an issue of first impression: whether a county’s immunity from taxation extends extraterritorially to property that it owns in another county. We conclude that it does not and reverse,” the court wrote.
