Indiana DOR Allows Nonresident Taxpayer to Net Gambling Losses Per Session

The Indiana Department of Revenue (DOR) issued Letter of Findings granting taxpayer’s individual income tax refund request for tax year 2024. Taxpayer recorded her wagering gains and losses from an Indiana casino on a per session basis, claiming a refund of the income tax withheld by the Indiana casino on her wagering gains. DOR denied the refund in part and adjusted Taxpayer’s Indiana’s income, resulting in an assessment of additional income tax, penalty, and interest.
