Indiana DOR Denies LLC’s Research Expense Credits for 2021-2022 Tax Years

The Indiana Department of Revenue (DOR) issued a letter of findings denying research expense credits claimed by an LLC and its members for the 2021 and 2022 tax years. The DOR held that the LLC did not establish it had qualified research expenses eligible for the credits under the requirements of I.R.C. § 41 and corresponding Indiana law. The DOR determined that the LLC failed to substantiate that its activities met the tests for determining eligibility for the expenses to qualify under I.R.C. § 174. [Ind.
