Lawyers Ask California AG to Halt Opinion on Tax Office Power

The California Attorney General’s Office should drop its plan to issue an opinion on the Office of Tax Appeals’ authority to invalidate state tax regulations because it would interfere with pending tax cases, tax practitioners said.

In written comments submitted to Attorney General Rob Bonta, tax lawyers said the office’s decision in July to accept the OTA’s request for an opinion violates its own policy barring the issuance of advisory opinions involving an issue that is currently being litigated.
