Louisiana Parishes Seek Dismissal of Sales Tax System Suit (1)

Tax collectors in three Louisiana parishes called on a federal judge to toss an online seller’s constitutional challenge to the state’s sales tax system, saying the lawsuit was barred under the Tax Injunction Act and was replete with “false and misleading allegations.”

Tax administrators from Lafourche, Tangipahoa, and Washington parishes on Wednesday sought dismissal of a suit filed by Arizona-based Halstead Bead Inc., which alleged Louisiana maintains an “arbitrary and fragmented” sales tax system that places unconstitutional burdens on interstate commerce. The parish-level tax administrators accused Halstead of wasting the court’s time with a list of falsehoods and “hypothetical burdens.” ...
