Maryland’s attorney general called on a federal appeals court to kill a challenge by business groups to the state’s digital advertising tax by affirming a pair of district court decisions dismissing the case.
Attorney General Anthony Brown (D) told the US Court of Appeals for the Fourth Circuit that the challenge filed by the US Chamber of Commerce and two technology trade groups can’t be heard in federal court because of the federal Tax Injunction Act, which bars US courts from hearing state tax disputes when viable state court venues are available.
