New York lawmakers will look to rewrite the state’s property tax enforcement laws this legislative session after the US Supreme Court last year deemed them unconstitutional.
Gov. Kathy Hochul (D) has proposed a budget bill that would require localities to return any profits from selling tax-delinquent properties to the former owners, instead of pocketing the money. The high court ruled in Tyler v. Hennepin County—a case pitting a Minnesota resident against her county government—that keeping the surplus is an unconstitutional taking.
