A New Hampshire supermarket that pays property tax for the site it leases properly asked for a tax abatement and established at trial that the abatement should be granted, the Supreme Court of New Hampshire said.
Shaw’s Supermarkets Inc. pays property tax to the town of Windham for its share of the property under the terms of its lease. The town denied its challenge to the 2017 tax assessment, saying Shaw’s lacked standing because it wasn’t the property owner.
