NY Punches Back in Professor’s Quest to Overhaul Telework Tax

New York’s method for taxing interstate remote workers is more relevant than ever as teleworking becomes more prevalent, the state tax department told an appeals court Thursday in a case brought by a Cardozo Law School professor.

The state’s brief comes in response to Edward Zelinsky’s appeal of a tax tribunal’s ruling that the state properly taxed his wages earned while working from his Connecticut home when Covid-19 pandemic restrictions barred him accessing the school’s Manhattan campus.

The current appeal at the New York Supreme Court, Appellate Division, Third Department, is Zelinsky’s latest parry in a crusade going back decades. ...
