The Oregon Tax Court ruled a cannabis growing company is entitled to claim an exclusion from gross income for various business expenses, rejecting the findings of an audit by the state Department of Revenue.
The tax court found Stephen and Ginger Lessey, who operate a marijuana cultivation business known as Oak Ponds Farm, are entitled to subtractions from their 2016 Oregon income tax return for business expenses for air conditioner depreciation, office rent, meals, and vehicle use. The decision, dated Tuesday, was rendered by Magistrate Judge Poul F. Lundgren.
