Pennsylvania BFR Grants Taxpayer LLC Abatement of Late Payment Penalties

The Pennsylvania Board of Finance and Revenue (BFR) granted the taxpayer LLC’s request for abatement of late payment penalties for the 2023 tax period. The taxpayer filed its 2023 Pennsylvania tax return late after receiving relevant income information from a third party. The Department of Revenue initially imposed late payment penalties and interest, which the taxpayer appealed. The BFR found that the taxpayer acted in good faith, without negligence, and without intent to defraud the Commonwealth, and therefore abated the penalties, ordering the Department to reassess the account with interest only.
