Pennsylvania BFR Grants Taxpayers Penalty Abatement for Personal Income Tax

The Pennsylvania Board of Finance and Revenue (BFR) granted the taxpayers a penalty abatement for their 2023 personal income tax. The taxpayers had filed a joint Pennsylvania resident tax return, but later claimed that the spouse was a Virginia resident and her income should not be taxable in Pennsylvania. While the BFR upheld the tax liability, it found that the taxpayers acted in good faith, without negligence, and without intent to defraud the Commonwealth, and therefore abated the assessed penalties based on the applicable statute.
